Deal terms

Licensing one set of records to several AI companies

That depends on your first license being non-exclusive. Some buyers insist on exclusivity, others limit it in time or skip it, so scrutinise this clause above all.

01

Exclusivity decides everything

Exclusive normally means no one but that buyer can use the records for the stated purpose, frequently for a set term. Non-exclusive normally lets you take the same records to other buyers.

Why a buyer wants exclusivity: a dataset rivals also hold is worth less to its customers. Why you might resist it: you lose the chance to license again if a better offer arrives. Exclusive terms should pay more for that reason.

02

Some buyers want to be first

Certain buyers only want firms that have never licensed data. Be upfront with each buyer about past deals, because concealing one could put you in breach.

03

Next year's records are new records

Your business keeps producing records after an exclusive deal on its past. A later deal could cover newer records or another system entirely, so have the first contract pin down the licensed records by dates and source.

04

Getting several quotes is normal

Collecting quotes before signing is not licensing twice. Buyers openly outbid each other: for Spirit Airlines' archive, Google put in $10M against Mercor's $7.5M, then micro1 came back with $12.5M. Nyne says it will try to top any offer in writing.
